Our research focuses on notarial law, specifically on the legal figure of the acquisitive prescription of ownership (usucapion), demonstrating the problems caused by the regulatory vacuum contained in section G of article 05 of law 27333, preventing the notary from qualifying the request for opposition to said property procedure; and at the same time determine the grounds on which it is convenient to grant powers to the notary to qualify said opposition, warning that, in such legal device, the legislator has not considered the powers or capacities of the notary as a legal professional, to the extent that said claim It does not need any legal support, causing free action on the part of the opponents. Given this, we conclude that the legal bases for which it is convenient to empower notaries is to facilitate physically and legally cleaning up the properties, contributing to a series of benefits and advantages, achieving greater registration formality. Likewise, we have considered that the legal physical sanitation of urban properties or urban expansion consists of the mechanism that causes entry into the public registry, thereby conferring per se material publicity of a de facto legal reality within the ownership guidelines.
