ABSTRACT Regulatory imprecision and its impact on the exercise of the right of withdrawal by the co- owner, Peru, 2013-2023”, is the topic of this research, which addresses, from a dogmatic, legislative and jurisprudential level, the scope of the articles 1596 and 1597 of the Civil Code. Taking into account the above, the thesis is composed of three parts: the first part is an introductory presentation that addresses the problematic reality, background, statement of the problem, the hypothesis, the objectives set and the research design, which includes research methods; The second part develops the theoretical framework of the right of withdrawal; and finally the third part focuses on the results of the research, the discussion of results, the conclusions reached and the recommendations to solve the problem posed here. Thus, although article 1596 of the Civil Code states that “the right of withdrawal must be exercised as of the communication of a certain date,” the truth is that we are dealing with an optional provision. In the same way, the regulation of article 1597, which reads “if the transferee knows of the transfer by any other means”, should be interpreted that the communication is effective even when the details of the sale have not been mediated
