ABSTRACT The thesis work leads us, from a new vision, of how to understand the Reform of the State, the Professionalization of Public Employment, the Professionalization of Public Administration and the Professionalization of Senior Public Management, to a new typology to classify the public worker. It starts from a sociological version: public worker; towards a legal-administrative version, where the public worker is classified, in three big blocks: 1) High State Official: article 99 of the Political Constitution of Peru, 2) Official and 3) Public Employee: Law No. 30057, Civil Service Law, and its Regulation approved by D.S. No. 040-2014-PCM, modified by D.S. No. 085-2021-PCM. It is specified, that the regulations of the Civil Service do not develop in a coherent way the conceptual differentiation of the public worker here exposed. Similarly, it is specified that the distinction of concepts that exists in Administrative Law, and in this thesis, is not applicable in Criminal Law because this legal discipline is interested in determining the existence of the link between the accused and the public administration, in order to establish the type of criminal injury in which the public administration and the State are injured, in accordance with article 425 of the Criminal Code.
