ABSTRACT The present research work, its general objective is: To demonstrate that the right to identity of children is violated before the impossibility of registering the birth of the minor, when such act is carried out only by the father without revealing the identity of the mother. The research developed is basic, non-experimental, descriptive, with a qualitative approach; Various techniques were used, such as documentary compilation and analysis, in addition to interviews with five experts on the subject matter of the research. Among the main findings found is that it was demonstrated without a doubt that the right to identity and all the rights that are related or detached from the recognition, enjoyment and enjoyment of this fundamental right are violated, even more so when it is not possible to register to these boys and girls for having outdated regulations, not in accordance with the advances in science, technology and genetics and the reality of the formation of new types of families. It is clear that it is important, urgent and necessary to modify the corresponding regulations in order to allow the registration of minors, when such act is carried out only by the father without revealing the identity of the mother.
