The objective of this work has been to determine what are the factors that influence the resocialization of the condemned, constitutionally recognized, not to be fulfilled in the penitentiary establishments of Amazonas by the year 2021, from that perspective, we have used in the first place the statistics that the National Penitentiary Institute (INPE) publishes on its website, being able to verify that the doctrinaires are right, there is no resocialization as such. We cannot ignore the fact that resocialization as a concept appears as a result of the humanization of punishment, since when private vendettas evolve to state punishment, and trying to precisely differentiate vendettas from punishment, a utility is sought for punishment, and this utility is said to be resocialization. For this reason, under a basic level of research - descriptive and the synthetic analytical method, we were able to conclude that there are three factors with direct influence on the resocialization not being fulfilled and these are the legal factor, determined by a violent and increasingly widespread use of life imprisonment, a political factor determined by the lack of conditions in the establishments to grant penitentiary benefits and a social factor, determined by overpopulation and prison overcrowding.
