La fe pública notarial como garantía de seguridad jurídica en la legislación penal Peruana

Abstract

El objetivo general de la tesis fue establecer la relación entre la fe pública notarial y la seguridad jurídica en la legislación penal peruana, para lo cual se utilizó la metodología de la investigación científica, instrumento que sirvió para desarrollar aspectos importantes del trabajo, desde su primer capítulo hasta el último. El nivel de investigación fue aplicado, tipo descriptivo. El universo estuvo conformado por abogados CAL, conocedores del tema, trabajadores de Sunarp, dependientes notariales, población estudiada fue de 200, abogados CAL, conocedores del tema, trabajadores de Sunarp, dependientes notariales. El instrumento utilizado para medir las variables fue el cuestionario constituido por 28 preguntas, 10 preguntas para medir la fe pública notarial y 10 preguntas para medir la variable seguridad jurídica, 8 preguntas relacionadas al tema de manera más general. Las 28 preguntas que fueron respondidas por los Abogados, quienes dieron sus diferentes puntos de vista sobre esta problemática, el instrumento aplicado fue sometido a juicio de expertos para comprobar su validez. Para la comprobación de hipótesis se utilizó la prueba estadística chi cuadrado SPSS, versión 24, con un nivel de significancia del 0.05. Encontrando los siguientes resultados: • Se ha demostrado que la fe pública notarial se relaciona favorablemente con la seguridad jurídica en la legislación penal peruana

The general objective of the thesis was to establish the relationship between notarial public faith and legal certainty in Peruvian criminal law, for which the methodology of scientific research was used, an instrument that served to develop important aspects of the work, from its first Chapter to the last. The level of research was applied, descriptive type. The universe was formed by attorneys CAL, knowledgeable about the subject, Sunarp workers, notary dependents, studied population was 200, lawyers CAL, knowledgeable about the subject, Sunarp workers, notary dependents. The instrument used to measure the variables was the questionnaire consisting of 28 questions, 10 questions to measure the public notarial faith and 10 questions to measure the variable legal security, 8 questions related to the topic more generally. The 28 questions that were answered by the Lawyers, who gave their different points of view on this problem, the instrument applied was submitted to expert judgment to verify its validity. Hypothesis testing was performed using the chi-square statistical test SPSS, version 24, with a significance level of 0.05.
