The main objective was to determine the influence of the existence of the source crime in the preparatory investigation for money laundering according to the New Peruvian Criminal Procedure Code. The research method and design used was ex post facto, because a previous problem was analyzed and no variable was manipulated, the level of investigation was explanatory, because the variables were related in cause or effect causal relationship, The population that was considered in the present investigation; 300 PNP DIRILA belonging to the Directorate of Investigation of Money Laundering, 500 DIVIDDMP belonging to the Investigation Division of Derived Complaints of the Public Ministry of the Investigation Directorate of Criminal Investigation, 200 criminal prosecutors that belong to the Specialty of Money Laundering , 300 fiscal function assistants who belong to the Money Laundering specialty and 10,000 lawyers who litigate in the Judicial District of Lima; and as a non-probabilistic sample or also intentional call: 60 PNP DIRILA. Directorate of Asset Laundering Investigation, 50 DIVIDDMP Division of Investigation of Derived Complaints of the Public Prosecutor's Office, 30 criminal prosecutors specializing in money laundering, 30 Fiscal Function Assistants and 40 Specialist Attorneys in Criminal Law, a total of 210 respondents. The instruments used for the measurement of the variables were the survey directed to the sample, selected in a random way. The statistical test used was chi-square, which consists of determining the causal relationship between the research variables. Finally, the hypothesis was verified, in which the existence of the source crime positively influences the preparatory investigation for money laundering according to the New Peruvian Criminal Procedure Code.
