La pericia grafotécnia como medio probatorio y la calificación del delito contra la fe pública en modalidad de falsificación de documentos públicos en los juzgados penales de La Corte Superior de Lima - 2017

Abstract

La investigación realizada tuvo como objetivo determinar la relación entre la pericia grafotécnia como medio probatorio con la calificación del delito contra la fe pública en modalidad de falsificación de documentos públicos en los Juzgados Penales de la Corte Superior de Lima-2017. En cuanto a la metodología el tipo de investigación que se empleo fue la no experimental, de corte transversal - Correlacional, se consideró el diseño que corresponde al no experimental ya que no se manipularon las variables, la población estuvo conformada por los Abogados de los Juzgados Penales de la Corte Superior de Lima y la muestra la representó 169. Las técnicas que se consideraron en el proceso de recolección de datos fueron de observación y de encuestas. Los instrumentos fueron los cuestionarios que se anexan al presente documento, en el proceso de la investigación se aplicó la contrastación de hipótesis. Como conclusión general tenemos: Puesto que X2 calculada es menor que X2 tabulada, en efecto se rechaza h0. Y se acepta la h1. Esto implica que la pericia grafotécnia como medio probatorio tiene una relación significativa con la tipificación del delito contra la fe pública en modalidad de falsificación de documentos públicos en los Juzgados Penales de la Corte Superior de Lima. Llegando a la conclusión que si existe una relación significativa entre ambas variables de estudio, tal como se afirma en la hipótesis de la investigación en un 95%, siendo la correlación de un 0.956 la cual es una correlación significativa con un margen de error de 0,05.

The realized investigation has as aim determine the relation between the know-how grafotécnia as evidential way with the classification of the crime against the public faith in modality of falsification of public documents in the Penal Courts of the Top Court of Lima 2017. As for the methodology the type of investigation that I use was the not experimental one, of transverse court - Correlacional, was considered to be the design that corresponds to the not experimental one since the variables were not manipulated, the population was shaped by the Attorneys of the Penal Courts of the Top Court of Lima and the sample her represented 169. The technologies that were considered in the process of compilation of information were of observation and of surveys. The instruments were the questionnaires that are annexed to the present document, in the process of the investigation the contrastación of hypothesis was applied. Since general conclusion we have: Since X2 calculated it is minor that X2 tabulated, in effect is rejected h0. And she is accepted h1. This implies that the know- how grafotécnia as evidential way has a significant relation with the classification of the crime against the public faith in modality of falsification of public documents in the Penal Courts of the Top Court of Lima. Coming to the conclusion that if a significant relation exists between both variables of study, as steadies itself in the hypothesis of the investigation in 95 %, being the correlation of 0.956 which is a significant correlation with a margin of mistake of 0,05.
