The crime of malfeasance is a figure, which is that an authority, judge or other public servant dictates an arbitrary resolution in an administrative or judicial matter knowing that said resolution is unfair and contrary to the law. The general objective of the research work was to determine if the crime of malfeasance in the jurisdictional exercise of the judges, affects the criminal sanction established in the Peruvian Legislation. The type of investigation was explanatory and the application level; On the other hand, the method and design of the research was expository or retrospective; and in relation to the population under study was constituted by the Lima Bar Association (CAL) and the sample was 378 skilled lawyers with a probability sample of 95% confidence and a margin of error of 5%. Regarding the instruments used to measure the variables, it was the survey technique with its instrument, the questionnaire, which was validated by expert Judges who made the evaluation with the Degree of Doctors, who gave the validation of criteria and construct; as for the statistical test it was the chi or chi square, corrected by Yates. In conclusion, it has been determined that the crime of malfeasance in the jurisdictional exercise of judges directly affects the criminal sanction established in the Peruvian Legislation.
