Abstract: La Responsabilidad del Notario abarca los ámbitos civil, penal, administrativo o fiscal y disciplinario. Por un mismo caso el notario puede responder simultáneamente en los distintos ámbitos. La diferencia radica en los distintos bienes o valores jurídicos protegidos que respectivamente tienden a tutelar: a) La responsabilidad civil surge cuando en el ejercicio de su función falta a los deberes propios de su actividad, e incumple obligaciones que y tengan origen convencional o legal por acción u omisión culposa o dolosa; b) La responsabilidad penal, aun admitiendo que el notario no es funcionario público, cada vez más que el Código Penal se tipifica un delito relacionado con los funcionarios públicos como sujetos activos del mismo; c) La responsabilidad fiscal, acontece por el incumplimiento de los deberes que corresponden por las leyes fiscales y tributarias; d) Responsabilidad disciplinaria, ocurre por infringir normas profesionales y éticas que lesionan el correcto desempeño de la función y provocan un daño a los particulares y a la institución
Con relación a la recopilación de la información del marco teórico, el aporte brindado por los especialistas relacionados con cada una de las variables: Responsabilidad del Notario y Acto jurídico, el mismo que clarifica el tema en referencia, así como también amplia el panorama de estudio con el aporte de los mismos; respaldado con el empleo de las citas bibliográficas que dan validez a la investigación. En suma, en lo concerniente al trabajo de campo, se encontró que la técnica e instrumento empleado, facilitó el desarrollo del estudio, culminando esta parte con la contrastación de las hipótesis.
Finalmente, los objetivos planteados en la investigación han sido alcanzados a plenitud, como también los datos encontrados en el estudio facilitaron el logro de los mismos. Asimismo merece destacar que para el desarrollo de la investigación, el esquema planteado en cada uno de los capítulos, hizo didáctica la presentación de la investigación, como también se comprendiera a cabalidad los alcances de esta investigación.
Notary Responsibility covers civil, criminal, administrative or fiscal and disciplinary areas. For the same case the notary can respond simultaneously in different areas. The difference lies in the different goods or protected legal values which respectively tend to protect: a) The liability arises when in the exercise of their lack to the duties of their activity, function and violates obligations and have a conventional or legal origin negligent or willful act or omission; b) Criminal liability, even admitting that the notary is a public official, increasingly the Criminal Code an offense relating to public officials as active typifies thereof; c) Fiscal responsibility, happens for breach of its duties by tax and tax laws; d) Disciplinary liability occurs for violating professional and ethical standards that harm the proper performance of the function and cause damage to individuals and the institution. With regard to the collection of information on the theoretical framework, the support provided by specialists related to each of the variables: Liability of the Notary and Legal act, the same one that clarifies the issue in question, as well as wide panorama of study with input thereof; backed by the use of citations which validate research. In addition, with regard to fieldwork, it was found that the techniques and instruments used, facilitated the development of the study, culminating this part with the testing of hypotheses. Finally, research objectives have been achieved fully, as well as data found in the study facilitated achieving them. Also worth mentioning that for the development of research, the scheme proposed in each of the chapters, made didactic presentation of research, as also fully understand the scope of this investigation.
