Ejecución de las medidas cautelares y la garantía al debido proceso en la legislación peruana

Abstract

La presente investigación titulada Ejecución de las medidas cautelares y la garantía al debido proceso en la legislación peruana, tiene como objetivo determinar la influencia de la ejecución de las medidas cautelares en la garantía al debido proceso en la legislación peruana. Se utilizó para alcanzar dicho objetivo el método ex-post-facto y un diseño no experimental, asimismo la población objeto estuvo constituida por 24,500 abogados hábiles del Colegio de Abogados de Lima a marzo de 2017, y el tamaño de la muestra fue de 378 personas a quienes se les aplicó la encuesta. En cuanto al instrumento de recolección de datos tenemos a la encuesta que constó de 14 ítems de tipo cerrado, los mismos que se vaciaron en cuadros en donde se calcularon las frecuencias y porcentajes, complementándose con el análisis e interpretación de los resultados, lo cual nos permitió contrastar las hipótesis. La prueba estadística utilizada fue la de Chi cuadrado, con margen de error de 0.05. Finalmente se concluyó que la ejecución de las medidas cautelares sí influyen directamente en la garantía al debido proceso en la legislación peruana

The present investigation entitled Execution of precautionary measures and guarantee of due process in Peruvian legislation has the objective of determining the influence of the execution of precautionary measures on the guarantee of due process in Peruvian legislation. The ex-post-facto method and a non-experimental design were used to achieve this objective. The target population was also constituted by 24,500 lawyers from the Bar Association of Lima in March 2017, and the sample size was 378 people to whom the survey was applied. As for the data collection instrument, the survey consisted of 15 closed-type items, the same ones that were emptied into tables where the frequencies and percentages were calculated, complemented by the analysis and interpretation of the results, which Allowed to contrast the hypotheses. The statistical test used was Chi squared distribution, with a margin of error of 0.05. Finally, it was concluded that the execution of precautionary measures have directly influence the guarantee of due process in Peruvian legislation
