Alcances de la función Pública del Notario en el divorcio por separación convencional en la Legislación Peruana

Abstract

La tesis se ha desarrollado con el fin de brindar aportes significativos respecto a los alcances que tiene la función del Notario en cuanto al divorcio por separación convencional de acuerdo a la legislación peruana, para lo cual se utilizó la metodología de la investigación científica, instrumento que sirvió para desarrollar aspectos importantes del trabajo, desde su primer capítulo hasta el último.

El estudio realizó la recopilación de información acerca de diferentes especialistas con respecto al desarrollo de las variables: función notarial y separación convencional; en cuanto al estudio de campo se utilizó la técnica de la encuesta con su instrumento el cuestionario la misma que estuvo conformada por 14 preguntas que fueron respondidas por los Abogados hábiles del CAL, quienes dieron sus diferentes puntos de vista sobre esta problemática, para luego ser llevadas a gráficos estadísticos, así como sus respectivas interpretaciones; desde luego, las hipótesis planteadas fueron contrastadas para luego arribar a las conclusiones y recomendaciones del trabajo.

Finalmente, en la última parte de la tesis concluye con los aportes que se dan como resultado de la investigación, los mismos que se alcanzaron a plenitud, facilitando las recomendaciones las cuales se consideran como viables y practicables; además se añade la amplia bibliografía, así como el anexo correspondiente.

The thesis has been developed in order to provide significant contributions regarding the scope of the Notary's role in the divorce by conventional separation according to Peruvian legislation, for which the methodology of scientific research was used, an instrument that it served to Develop important aspects of the work, from its first chapter to the last.

The study carried out the collection of information about different specialists regarding the development of variables: notarial function and conventional separation; As for the field study, the technique of the survey was used with its instrument, the questionnaire, which was made up of 14 questions that were answered by the skilled lawyers of the CAL, who gave their different points of view on this problem, and then Taken to statistical graphs, as well as their respective interpretations; Of course, the hypotheses were contrasted before arriving at the conclusions and recommendations of the work.

Finally, in the last part of the thesis concludes with the contributions that are given as a result of the research, the same ones that were reached to fullness, facilitating the recommendations which are considered as viable and practicable; In addition the extensive bibliography is added, as well as the corresponding annex.
