La prueba testimonial en el delito de aborto y sus alcances en la decisión final del juez

Abstract

En cuanto al desarrollo del marco teórico, fue importante el aporte brindado por los especialistas relacionados con cada una de las variables: prueba testimonial y decisión final del Juez, el mismo que clarificó el tema de la tesis, así como también amplió el panorama de estudio con el aporte de los mismos; respaldado con el empleo de las citas bibliográficas que dan validez a la investigación. En cuanto al objetivo general del trabajo de investigación fue establecer si la prueba testimonial en el delito de aborto, incidirá en la decisión final del juez. Además, el tipo de investigación fue explicativo y el nivel aplicativo; con relación a la población objeto de estudio estuvo constituida por el Colegio de Abogados de Lima (CAL) y la muestra fue de 264 Abogados hábiles con un muestreo probalístico de probabilidad del 95% de confianza y con un margen de error de 6%

Regarding the development of the theoretical framework, it was important the contribution provided by the specialists related to each of the variables: testimonial test and final decision of the Judge, which clarified the topic of the thesis, as well as broadened the scope of the study with the contribution of them; supported with the use of bibliographic citations that validate the research. Regarding the general objective of the research work was to establish whether the testimonial evidence in the crime of abortion, will affect the final decision of the judge. In addition, the type of research was explanatory and the application level; in relation to the population under study, it was constituted by the Lima Bar Association (CAL) and the sample was 264 skilled lawyers with a probalistic probability sample of 95% confidence and with a margin of error of 6%.
