El derecho a la libertad de la persona humana y la seguridad jurídica en el Perú

Abstract

Como se puede apreciar la libertad que posee el ser humano, implica que uno puede hacer lo que quiera, pero dentro del marco de la ley; pues es uno de los derechos civiles que tenemos y el más importante, dado que sin su reconocimiento muchos de los demás no podrían ejercerse. En tal sentido, la persona humana busca la seguridad que necesita ante cualquier situación que pudiera presentarse y tener la confianza que se hará justicia; es por eso que se debe tener en cuenta que la libertad es lo más preciado que uno tiene en la vida. Es por eso, que el objetivo general del trabajo de investigación fue demostrar si el derecho a la libertad de la persona humana, está garantizado la seguridad jurídica en el Perú. Además el tipo de investigación fue explicativo y el nivel aplicativo; con relación a la población objeto de estudio estuvo constituida por el Colegio de Abogados de Lima (CAL) y la muestra fue de 233 Abogados hábiles con un muestreo probalístico de probabilidad del 95% de confianza y con un margen de error de 5%. Los instrumentos utilizados para la medición de las variables fueron validados por jueces expertos para ello realizaron la evaluación de 3 doctores en Derecho, quienes dieron la validación de criterios y de constructo. En conclusión, los datos obtenidos y posteriormente contrastado demostró que el derecho a la libertad de la persona humana, está garantizado favorablemente con la seguridad jurídica existente en el Perú.

As one can appreciate the freedom that has the human being, implies that one can do what he wants, but within the framework of the law; Because it is one of the civil rights that we have and the most important, since without their recognition many of the others could not be exercised. In this sense, the human person seeks the security he needs before any situation that could arise and have the confidence that justice will be done; That is why you must keep in mind that freedom is the most precious thing you have in life. That is why the general objective of the research work, was to demonstrate if the right to freedom of the human person is guaranteed legal security in Peru. In addition, the type of investigation was explanatory and the application level; in relation to the population under study, it was constituted by the Bar Association of Lima (CAL) and the sample was 233 skilled lawyers with a probalistic sampling probability of 95% confidence and with a margin of error of 5%. The instruments used for the measurement of the variables were validated by expert judges. For this, they carried out the evaluation of 3 doctors in law, who gave the validation of criteria and construct. In conclusion, the data obtained and subsequently contrasted showed that the right to freedom of the human person is guaranteed favorably with the legal security existing in Peru
