Abstract: La presente investigación tiene como objetivo general identificar una serie de problemas que
afectan la tasa de aplicación y, por otro lado, desde la dimensión de su importancia, intenta
proponer resultados a cada uno de estos problemas.
La presente tesis constituye una investigación explicativa porque evaluaremos si esta
institución basada en las diversas fundamentaciones que la apoyan, busca superar las
deficiencias del sistema procesal, basándose en los cambios legales que propone, así como
identificar algunas dificultades derivadas de su aplicación en el sistema de justicia estatal
peruano.
La principal conclusión es que la tasa de aplicación de los Criterios de Oportunidad se basa
en el nivel de interpretación y apropiada de los operadores del derecho sobre las categorías
legales criminales relacionadas con la Teoría del Delito y también de las Consecuencias
Jurídicas del Delito.
The present investigation is general objective to identify a series of problems that affect the rate of application and, on the other hand, from the dimension of its importance, try to propose results to each one of these problems. This thesis is a explanatory research because we will evaluate if this institution based on the various foundations that support it, seeks to overcome the deficiencies of the procedural system, based on the legal changes proposed, as well as identify some difficulties derived from its application in the Peruvian state justice system. The main conclusion is that the rate of application of the Opportunity Criteria is based on the level of interpretation and appropriateness of the operators of the law on the criminal legal categories related to the Theory of Crime and also of the Legal Consequences of Crime.
