Aplicación del principio ne bis in ídem como derecho fundamental y el control del procedimiento administrativo sancionador

Abstract

La investigación tiene como objetivo determinar la incidencia de la aplicación del principio ne bis in ídem como derecho fundamental en el control del procedimiento administrativo sancionador en el Cercado de Lima, 2015. Se utilizó para alcanzar dicho objetivo el método descriptivo y un diseño no experimental, asimismo de la población constituida por 345 abogados de la especialidad de Derecho Administrativo y Derecho Penal ubicados en el cercado de Lima metropolitana. Al calcular el tamaño de la muestra se trabajó finalmente con 182 personas. En cuanto al instrumento de recolección de datos tenemos al cuestionario que constó de 12 ítems de tipo cerrado, los mismos que se vaciaron en cuadros en donde se calcularon las frecuencias y porcentajes, complementándose con el análisis e interpretación de los resultados, lo cual nos permitió contrastar las hipótesis. Finalmente se concluyó La aplicación del principio non bis in ídem como derecho fundamental incide positivamente en el control del procedimiento administrativo sancionador en el Cercado de Lima, 2015
