Abstract: El presente trabajo de investigación titulado: EL LÍMITE DE EDAD PARA ACCEDER A LA EDUCACIÓN PRIMARIA Y EL INTERÉS SUPERIOR DEL NIÑO, se origina como preocupación frente a este tema muy polarizado. Por un lado, están las normas como la Constitución Política del Perú y el Interés Superior del Niño que deben tenerse en cuenta al momento de administrar justicia para no afectar los intereses de algún menor. Por el otro lado, estas normas resultan inflexibles y omiten nuestra realidad diversificada catalogando a todos los niños por igual, desconociendo así que hay niños que cuentan con un entorno favorable y las condiciones necesarias para iniciar sus procesos de desarrollo a temprana edad. Sin embargo, lo único que logra el Estado con estas normas es violentar el derecho de estos niños.
Asimismo, más allá de la maduración biológica como factor preponderante para el desarrollo del pensamiento, está primero las condiciones del entorno. Son estas las que al final determinan el desarrollo cognitivo y de las otras dimensiones del estudiante. Por lo tanto, el criterio de la edad cronológica no es determinante, por lo que en muchos casos puede constituir un perjuicio para un niño que ha crecido en un entorno favorable. Desde esta perspectiva, y siendo el Perú un país con amplia brecha socioeconómica, se presume que el límite de edad para acceder al primer grado de primaria, colisiona con los derechos de muchos niños con las condiciones necesarias para empezar a estudiar a temprana edad.
Finalmente, preciso que, la presente investigación me permitió confirmar mi hipótesis planteada; y al mismo tiempo, servirá de precedente a futuras investigaciones, a fin de superar lo hasta aquí logrado. Considero que toda investigación es un proceso y un producto, no es un conocimiento absoluto; por lo tanto, la investigación queda abierta.
This research paper entitled: THE AGE LIMIT TO ACCESS PRIMARY EDUCATION AND THE CHILD'S HIGHEST INTEREST, originates as a concern regarding this highly polarized issue. On the one hand, there are the rules such as the Political Constitution of Peru and the Best Interest of the Child that must be taken into account when administering justice so as not to affect the interests of any minor. On the other hand, these norms are inflexible and omit our diversified reality, cataloging all children equally, thus ignoring that there are children who have a favorable environment and the necessary conditions to start their development processes at an early age. However, the only thing the State achieves with these norms is to violate the rights of these children. Likewise, beyond biological maturation as a preponderant factor for the development of thought, there is first the environmental conditions. It is these that ultimately determine the student's cognitive and other dimensions. Therefore, the criterion of chronological age is not decisive, so in many cases it can be detrimental to a child who has grown up in a favorable environment. From this perspective, and since Peru is a country with a wide socioeconomic gap, it is presumed that the age limit to access the first grade of primary school, collides with the rights of many children with the necessary conditions to start studying at an early age. Finally, I specify that the present investigation allowed me to confirm my hypothesis; and at the same time, it will serve as a precedent for future research, in order to overcome what has been achieved so far. I consider that all research is a process and a product, it is not an absolute knowledge; therefore, the investigation remains open.
