Abstract: El presente trabajo es laboral denominado “El Precedente Huatuco desde el control de Constitucionalidad y Convencionalidad” muchas empresas privadas y públicas ante su despido arbitrario a trabajadores en materia de contratos de plazo determinado, prestación personal de servicios, subordinación.
He considerado materia Legislación, doctrina y Jurisprudencia Constitucional: Precedente caso Huatuco empleando métodos de investigación: Método analítico, deductivo, jurídico (exegético dogmático); asi como técnicas e instrumentos (fichaje, análisis documental, ficha informativa)
El precedente vinculante tiene los efectos de una Ley por tanto estos no pueden afectar ni mucho menos desconocer e ir por encima de Normas Constitucionales, principio de jerarquía de normas, en aplicación estricta del artículo 51 de nuestra Constitución Política del Estado prescribe que: “La Constitución prevalece sobre toda norma legal”. Por tanto, el precedente Huatuco al desconocer un derecho ya adquirido por la desnaturalización de un contrato de trabajo, el cual es la condición de un trabajador con contrato a plazo indeterminado y si es despedido su reposición en el mismo puesto, en aplicación del Artículo 27 de Constitución que prescribe: “La Ley otorga al trabajador adecuada contra el despido arbitrario” corresponde al Principio de Jerarquía normativa el precedente Huatuco.
De Irrenunciabilidad de derechos (inciso 2) del artículo 20 de la Constitución Política del Estado, atendiendo al carácter irrenunciable de los derechos laborales que preconiza el artículo 26 de la Constitución, resulta relevante destacar la continuidad en las labores administrativas realizadas por la demandante independientemente de la modalidad de su contratación, hecho que permite concluir que los supuestos contratos de locación de servicios y contratos administrativos de servicios encubrieron, en realidad, una relación de naturaleza laboral y no civil, por lo que la actora solamente podía ser despedida por causa derivada de su conducta o capacidad laboral que lo justifique; lo que no ha ocurrido en el presente caso (resaltado y subrayado es nuestro). Son Derechos Vulnerados.
Derecho a la Dignidad y situación del Trabajador (artículo 1 de la Constitución Política del Estado)
Quien ofrece mejores beneficios laborales al trabajador es justamente el trabajador que está sujeto al régimen laboral privado común, muy por encima del régimen de contratación administrativa de servicios (CAS), por tanto la variación de una modalidad mas progresista a una menor protección y beneficios, implica un reducción de los derechos o condiciones ya otorgada al trabajador, lo cual implicaría una regresividad de beneficios, que atenta contra la dignidad y situación del trabajador, en aplicación del artículo 1 de la Constitución (Derechos Vulnerados)
Principio de Progresividad de los derechos laborales justamente la imposibilidad de que se reduzca o ilumine la protección o reconocimiento de un derecho o condición ya otorgada al trabajador, debiendo primar el criterio de conservación o no derogación del régimen más favorable para éste; por tanto el Estado no puede emitir una medida legislativa o judicial tendiente a disminuir un derecho o situación jurídica ya reconocida, a la parte más débil de la relación laboral (Derechos que vulnera el precedente) “Artículo 26 de la Convención Americana de Derechos Humanos. Desarrollo Progresiva” (Artículo 2.1 del Pacto Internacional de Derechos Económicos, Sociales y Culturales”.
