Informe de expediente civil Nº 006944-2006-0- 1601-JR-CI-06

Abstract

La realización del presente informe versa sobre el análisis del Proceso Civil signado bajo el Expediente Civil Nº 006944-2006-0-1601-JR-CI-06, el cual fue tramitado ante el Sexto Juzgado Especializado en lo Civil de la Corte Superior de Justicia de La Libertad, despachado inicialmente por la Dra. María Collette UCEDA VELEZ y actuando como especialista judicial la Dr. Nelly Munayco Castillo 1 tramitándose en el Proceso abreviado. En el referido proceso civil, intervinieron las siguientes partes: María Isabel SILVA MALABRIGO en calidad de demandante, quien, con fecha 04 de abril de 2006 interpone demanda de PRESCRIPCION ADQUISITIVA DE DOMINIO contra Harold Ricardo COELLO CUBA (Titular Registral) y Jetshy PEREYRA CASTAÑEDA (colindante del predio materia de Sub Litis), los demandados, en adelante. Mediante el cual la actora alega ser poseedora actual por más de 10 años de forma pública, pacífica, continua y en calidad de propietaria del bien inmueble sito en calle Las Turquezas N°430, Dpto. 202, Urbanización Santa Inés, distrito y provincia de Trujillo, en adelante el inmueble; por lo que, solicita: se declare propietaria del bien materia de Litis, a través de la demanda de Prescripción Adquisitiva de Dominio. Por su parte, el demandado Harold Ricardo COELLO CUBA, se opone a la demanda interpuesta por la recurrente, puesto que él tiene la titularidad del inmueble en litigio inscrito en Registros Públicos, señalando la Partida Registral N°03020984, adquiriendo dicha propiedad en mérito a la compraventa por parte de sus anteriores.

The realization of this report is about the analysis of the Civil Process signed under the Civil File No. 006944-2006-0-1601-JR-CI-06, which was processed before the Sixth Specialized Civil Court of the Superior Court of Justice of La Libertad, initially dispatched by Dr. María Collette UCEDA VELEZ and acting as a judicial specialist Dr. Nelly Munayco Castillo 1 processed in the abbreviated process. In the aforementioned civil proceedings, the following parties intervened: María Isabel SILVA MALABRIGO as plaintiff, who, on April 4, 2006, interposed demand for DOMESTIC ACQUISITION PRESCRIPTION against Harold Ricardo COELLO CUBA (Registral Holder) and Jetshy PEREYRA CASTAÑEDA (adjoining the subject matter of Sub Litis), the defendants, hereinafter. Through which the plaintiff claims to be current owner for more than 10 years publicly, peacefully, continuously and as the owner of the real property located in Turques Street No. 430, Dept. 202, Urbanization Santa Inés, district and province of Trujillo, hereinafter the property; therefore, it requests: the property of Litis be declared the owner of the property, through the application of Domain Procurement Requirement. For its part, the defendant Harold Ricardo COELLO CUBA, opposes the lawsuit interposed by the appellant, since he has the ownership of the property in litigation registered in Public Registries, noting Register No. 03020984, acquiring said property in merit to the sale by his previous.
