Abstract: El propósito de estudio de esta tesis es analizar los desafíos que surgirían de la posible inclusión de los neuroderechos, en el marco legal vigente peruano. La neurotecnología actualmente plantean intrusiones físicas y emocionales en la mente de las personas, que tendría como consecuencia la vulneración de ciertos derechos constitucionales, específicamente los derechos fundamentales. La información sobre dichas tecnologías y la respuesta desde la ciencia del Derecho, debido a su relevancia actual, es amplia, sin embargo, a nivel local, no existe una propuesta legal para regular su uso.
En resumen, estas herramientas tecnológicas, plantean riesgos de violaciones físicas y mentales que podrían ser excesivas para las personas, lo cual requiere una protección adecuada en términos de Derechos fundamentales. Este campo del derecho está estrechamente vinculado con la preservación del principio de la dignidad humana. La sociedad actual se enfrente a un desafío complejo en diversos ámbitos como el político, económico, tecnológico, ético-filosófico y sustancialmente jurídico. Es crucial abordar este desafío en función de generar una conciencia sobre los DD.FF y difundir su conocimiento a través de la investigación, como se pretende evidenciar en este caso.
This thesis aims to analyze the challenges that would arise from the possible inclusion of Neurorights in the current Peruvian legal framework. Neurotechnology currently poses physical and emotional intrusions into people's minds, which would violate certain constitutional rights, specifically fundamental rights. Due to their current relevance, the information about these technologies and the response from legal science is extensive; however, at the local level, there is no legal proposal to regulate their use. In summary, these technological tools pose risks of physical and mental violations that could be excessive for people, which requires adequate protection in terms of fundamental rights. This field of law is closely linked to the preservation of the principle of human dignity. Today's society faces a complex challenge in various areas such as political, economic, technological, ethical-philosophical, and substantial legal. It is crucial to address this challenge to generate awareness about human rights and disseminate knowledge through research, as is intended to be demonstrated in this case.
