In Peru, in the years 2018 and 2021, there was an increase in appeals filed with the Appeals Board for User Claims (JARU) of the Supervisory Body for Investment in Energy and Mining (Osinergmin). These appeals were submitted by users of public electricity and natural gas pipeline services, largely due to estimated consumption billing and/or their settlements. This increase in appeals was mainly attributed to the fact that the companies providing these services encountered difficulties in carrying out monthly billing during the States of Emergency declared due to the effects of the natural disaster known as “El Niño Costero“ in 2017 and to prevent the spread of the COVID-19 in 2020. Additionally, a special procedure was established to handle claims related to estimated consumption during the State of Emergency declared to prevent the spread of COVID-19 and its settlement. However, despite this, JARU did not resolve the majority of the claims within the established timeframe of the aforementioned special procedure, generating discomfort for users due to the delay in attention and the release of disputed amounts of claims that they had not yet exhausted the administrative route. In this sense, this sufficiency study focused on the regulations used to address electricity and natural gas pipeline consumption claims and the resolution criteria employed by the Unipersonal Room 1 of JARU. The aim was to enhance the process of addressing claims during States of Emergency declared by the government due to natural disasters or pandemics that prevent meter reading for monthly consumption billing. It was determined that the special procedure does not allow for the timely identification of errors in meter reading or the verification of whether electricity meters are operating within their lifespan or whether natural gas meters have undergone their quinquennial inspection. Furthermore, the established timeframe for issuing the initial resolution was deemed excessive. Therefore, it is proposed to partially amend the special procedure to address the aforementioned issues.
