Abstract: El siguiente estudio evalúa los componentes ambientales y mineros entorno a una unidad minera de acuerdo a la función evaluadora, supervisora y fiscalizadora del Organismo de Evaluación y Fiscalización Ambiental (OEFA) establecida en la Ley N° 29325, Ley del Sistema Nacional de Evaluación y Fiscalización Ambiental (SINEFA), asimismo, se detalla los componentes mineros que inciden o generan impactos en el área de influencia ambiental, esto de acuerdo a los Instrumentos de Gestión Ambiental (IGA) aprobados al titular minero del proyecto.
Asimismo, el desarrollo de la presente tesis de sustenta en la evaluación y supervisión ejecutada por el Organismo de Evaluación y Fiscalización Ambiental (OEFA) durante el año 2017 y los Estudios de Impacto Ambiental aprobados, por lo que, se analiza las características ambientales descritas en la Línea Base de la unidad minera, los componentes mineros y la calidad de los factores ambientales durante el proceso de fiscalización del OEFA, a fin de evaluar el nexo causal de la afectación en el área de influencia de la unidad minera.
El Plan de Manejo Ambiental es el producto de la evaluación de las actividades a desarrollar durante la operación del proyecto minero, orientada en prevenir, mitigar, corregir o compensar los impactos ambientes contemplados en los Instrumentos de Gestión Ambiental, de no estar contemplado un impacto ambiental y por ende su medida ambiental el titular debe adoptar medidas de prevención y control a fin de evitar un impacto ambiental en concordancia con la normativa ambiental vigente – Artículo 16 del Reglamento de Protección y Gestión Ambiental para las Actividades de Explotación, Beneficio, Labor General, Transporte y Almacenamiento Minero, aprobado mediante Decreto Supremo N° 040-2014-EM.
The following study evaluates the environmental and mining components around a mining unit according to the evaluation, supervision and oversight function of the Environmental Evaluation and Oversight Agency (OEFA) established in Law No. 29325, Law of the National System of Environmental Evaluation and Oversight (SINEFA), also, it details the mining components that affect or generate impacts in the area of environmental influence, this according to the Environmental Management Instruments (IGA) approved to the mining owner of the project. Likewise, the development of this thesis is based on the evaluation and supervision carried out by the Environmental Evaluation and Oversight Agency (OEFA) during 2017 and the approved Environmental Impact Studies, therefore, the environmental characteristics described in the Baseline of the mining unit, the mining components and the quality of the environmental factors during the OEFA oversight process are analyzed in order to evaluate the causal nexus of the impact on the area of influence of the mining unit. The Environmental Management Plan is the product of the evaluation of the activities to be developed during the operation of the mining project, aimed at preventing, mitigating, correcting or compensating the environmental impacts contemplated in the Environmental Management Instruments, if an environmental impact is not contemplated and therefore its environmental measure the holder must adopt prevention and control measures in order to avoid an environmental impact in accordance with current environmental regulations - Article 16 of the Environmental Protection and Management Regulations for Mining Exploitation, Beneficiation, General Labor, Transport and Storage Activities, approved by Supreme Decree No. 040-2014-EM.
