Abstract: La clonación de tarjetas de créditos y débitos viene a ser uno de los más importantes delitos informáticos que se comete en el sistema comercial y financiero de cualquier economía de un país en el orbe, motivado por la globalización donde el nivel de delincuencia se ha incrementado de uno o dos individuos hasta conformar grupos de criminales, utilizan diminutos dispositivos electrónicos para copiar datos de la información que se encuentra en las bandas magnéticas de los medios de pagos de sus titulares, luego es traspasado a una nueva tarjeta con nombre de usuario diferente, cuyo objetivo es sustraer dinero ajeno u efectuar pagos de servicios prestados.
El Congreso de la República, en el año 2013, crea la Ley N.° 30096, Ley de Delitos Informáticos, como norma especial e incorpora en su artículo ocho, la clonación de tarjetas de créditos y débitos a fraudes informáticos que afecta al patrimonio, cuyo fin es armonizar, prevenir, buscar un régimen único rápido y eficiente, acorde con las normas de este primer tratado internacional, el Convenio de Budapest del año 2001.
La Ley N.º 30177, Ley que Modifica La Ley de Delitos Informáticos del año 2014, fue dado por el Congreso de la República, tenía la necesidad de regularizar la Ley N.º 30096, una de la más importante, se incorporaron dos palabras, el que “deliberadamente e ilegítimamente” modificaron en la mayoría de artículos de esta ley, donde subsanaba y sincronizaba con las normas del Convenio descrito en el párrafo anterior.
La investigación se llevó, a cabo recopilando datos informativos, información de medios escritos, electrónicos, audios y otros, teniendo en cuenta en este tema, se extrae nuevas ideas que servirán para consolidar la ley con la clonación de tarjetas de créditos y débitos, para esto se hizo un análisis de la parte teórica, legislativa y del único convenio internacional que recientemente el Perú se adhirió, y por el último sacamos conclusiones sobre la compatibilidad del delito con el derecho penal.

Law No. 30177, Law Amending The Computer Crime Law of the year 2014, was given by the Congress of the Republic, had the need to regularize Law No. 30096, one of the most important, two words were incorporated, the one that “deliberately and illegitimately“ modified in most articles of this law, where it remedied and synchronized with the rules of the Convention described in the preceding paragraph. The research was carried out by collecting informative data, information from written and electronic media, audios and others, taking into account in this topic, new ideas are extracted that will serve to consolidate the law with the cloning of credit and debit cards, for this we made an analysis of the theoretical, legislative and the only international convention that recently Peru adhered, and finally we draw conclusions about the compatibility of the crime with criminal law.
