La responsabilidad social empresarial y el proceso de resocialización del adolescente infractor a la Ley Penal

Abstract

Actualmente la gran mayoría de iniciativas para reducir los altos índices de delincuencia juvenil provienen del ámbito empresarial y sus acciones socialmente responsables, como parte de su filosofía empresarial, con el propósito de promover una sociedad inclusiva con mayores oportunidades para los adolescentes que cometieron algún ilícito (infractores) y que ya cumplieron su sanción respectiva y que buscan una oportunidad para poder reinsertarse a la sociedad. Los acciones realizadas por las empresas como parte de su RSE son muy diferentes a los que aplica el sistema de justicia tradicional; por el contrario, sus iniciativas buscan reducir los altos índices de reincidencia en relación a la delincuencia juvenil a través del desarrollo de proyectos, programas, cursos, jornadas, etc. que cuentan con un alto espectro social, filantrópico y retributivo. La RSE cumple un rol fundamental para la prevenir las acciones delictivas en los jóvenes, principalmente implementando acciones de control informales, permitiendo que el Estado no sea el único responsable de su mitigación, debido a que esta problemática para ser combatida de manera frontal y decidida debe contar con la contribución de todos los agentes que conforman la sociedad en general, de esta manera poder democratizar esta lucha, siendo la misma comunidad conjuntamente con las empresas socialmente responsables sean quienes puedan identificar, diagnosticar, controlar y gestionar soluciones concretas y viables a los problemas que devienen de la delincuencia juvenil.

The actions carried out by companies as part of their CSR are very different from those applied by the traditional justice system; on the contrary, its initiatives seek to reduce the high rates of recidivism in relation to juvenile delinquency through the development of projects, programs, courses, conferences, etc. that have a high social, philanthropic and retributive spectrum. CSR plays a fundamental role in preventing criminal actions in young people, mainly by implementing informal control actions, allowing the State not to be solely responsible for their mitigation, because this problem must be combated head-on and decisively. count on the contribution of all the agents that make up society in general, in this way being able to democratize this struggle, being the same community together with socially responsible companies who can identify, diagnose, control and manage concrete and viable solutions to problems arising from juvenile delinquency.
