Abstract: El derecho de toda persona a heredar se encuentra debidamente reconocida en nuestra actual Constitución (inciso 16 del artículo 2), de igual forma, el concubinato (artículo 5). Con respecto al matrimonio, el o la cónyuge supérstite goza de los derechos sucesorios del cónyuge fallecido, ello por mandato legal; bajo la misma lógica y a partir de la dación de la Ley N.º 30007, se ha reconocido para el conviviente supérstite el goce de derechos sucesorios del conviviente fallecido, recordando que antes de dicha ley, el concubinato carecía de derechos sucesorios. Antes del reconocimiento de los derechos sucesorios para el conviviente supérstite, debe reconocerse formalmente el concubinato, para cuyo efecto, se deben demostrar con el cumplimiento de determinados requisitos previstos en la ley, esto es, debe ser voluntaria, heterosexual, estable, sin impedimento matrimonial y notoria, asimismo, inscribirse en el Registro Personal. Pues, el reconocimiento de derechos para el concubinato –entre ellos los derechos sucesorios–, similares al del matrimonio, responde a la necesidad que se presenta en nuestra realidad, dado que, es más frecuente la presencia de uniones no matrimonial, por ello, siendo el concubinato fuente de familia –como lo es el matrimonio por excelencia–, su reconocimiento constitucional y legal responde a la libertad de la persona, el derecho de conformar una familia y a la autonomía que poseen las parejas. A partir de dicha ley dictada en el año 2013, se ha reconocido de manera taxativa los derechos sucesorios para el conviviente supérstite, partiendo de reconocer al concubino como uno de los herederos forzosos, ocupando el tercer orden sucesorio, tal como sucede al cónyuge en el caso del matrimonio.
The right of every person to inherit is duly recognized in our current Constitution (paragraph 16 of article 2), in the same way, concubinage (article 5). With respect to marriage, the surviving spouse enjoys the inheritance rights of the deceased spouse, by legal mandate; under the same logic and from the enactment of Law No. 30007, the enjoyment of inheritance rights of the deceased partner has been recognized for the surviving cohabitant, remembering that before said law, the concubinage lacked inheritance rights. Before the recognition of the inheritance rights for the surviving cohabitant, the concubinage must be formally recognized, for which purpose, they must be demonstrated with the fulfillment of certain requirements provided for in the law, that is, it must be voluntary, heterosexual, stable, without marriage impediment. and notorious, likewise, enroll in the Personal Registry. Thus, the recognition of rights for concubinage –including succession rights–, similar to those of marriage, responds to the need that arises in our reality, given that the presence of non-marital unions is more frequent, therefore, being concubinage as a source of family –as is marriage par excellence–, its constitutional and legal recognition responds to the freedom of the person, the right to form a family and the autonomy that couples possess. From said law enacted in 2013, the succession rights for the surviving cohabitant have been strictly recognized, starting from recognizing the common-law spouse as one of the forced heirs, occupying the third order of succession, as happens to the spouse in the marriage case.
