Abstract: Este trabajo de investigación tuvo el propósito de conocer la asociación entre las medidas legales protectoras de la violencia familiar y su prevención, en el marco del derecho penal peruano. Este trabajo está basado en una revisión bibliográfica y en los resultados de una encuesta que usó un cuestionario con escala tipo Likert. La revisión bibliográfica comprobó que en el Perú, se cuenta con diversas leyes y dispositivos legales de protección contra la violencia familiar y de la violencia contra la mujer como la Ley N° 30364 “Ley para prevenir sancionar y erradicar la violencia contra las mujeres y los integrantes del grupo familiar”, con lo cual se pretende erradicar estos actos y brindar justicia a las víctimas; sin embargo, a pesar de estos buenos intentos de protección legal, lamentablemente dicha legislación peruana muestra diversas deficiencias en su aplicación y resultados, evidenciándose la necesidad de reformarlas. Sobre la prevención de la violencia familiar se comprobó también, que en el Perú existe el Programa Nacional para la Prevención y Erradicación de la Violencia contra las Mujeres e Integrantes del Grupo Familiar, que ejecuta acciones de atención, prevención y apoyo a aquellas personas que sufren de violencia familiar y sexual. Los pobladores peruanos encuestados opinaron que el tema de la protección y prevención de la violencia familiar es una problemática vigente y preocupante, que están de acuerdo con la existencia de las medidas de protección legales, pero que en la práctica se desconoce y no se cumple. Los resultados de la encuesta evidenciaron que existe una relación significativa entre las medidas de protección a la violencia familiar y la prevención. Asimismo, se demostró la asociación entre las medidas legales protectoras de la violencia familiar con su prevención primaria (evitar), secundaria (detectar) y terciaria (corregir).
This research work had the purpose of knowing the association between the legal measures to protect family violence and its prevention, within the framework of Peruvian criminal law. This work is based on a literature review and the results of a survey that used a questionnaire with a Likert-type scale. The literature review found that in Peru, there are various laws and legal devices to protect against family violence and violence against women such as Law N° 30364 “Law to prevent, sanction and eradicate violence against women and members of the family group”, with which it is intended to eradicate these acts and provide justice to the victims; however, despite these good attempts at legal protection, unfortunately said Peruvian legislation shows various deficiencies in its application and results, evidencing the need to reform them. Regarding the prevention of family violence, it was also verified that in Peru there is a National Program for the Prevention and Eradication of Violence against Women and Members of the Family Group, which executes care, prevention and support actions for those who suffer of family and sexual violence. The Peruvian residents surveyed believed that the issue of protection and prevention of family violence is a current and worrying problem, that they agree with the existence of legal protection measures, but that in practice it is unknown and is not fulfilled. The results of the survey showed that there is a significant relationship between protection measures against family violence and prevention. Likewise, the association between legal measures to protect family violence with its primary (avoid), secondary (detect) and tertiary (correct) prevention was demonstrated.
