Abstract: El hurto y robo en el Perú son los delitos más comunes, por ser de mayor incidencia y más afecta al patrimonio del ciudadano común y corriente; los antecedentes de estos delitos lo tenemos en el imperio romano que en su legislación exigía el dolo al apoderamiento ilegítimo; el Perú tiene en su legislación aparte de la influencia romana, la española y germánica, donde predomina la protección al patrimonio de las personas; estos delitos mantienen un crecimiento tal como lo señalan los informes periódicos, las acciones de las autoridades políticas, policiales y judiciales no son efectivas; las causas tienen origen socioeconómicos y culturales, es por eso que contrarrestarlo compromete sectores multisectoriales incluido la colectividad.
El Código Penal Peruano de 1991, contemplo los delitos de hurto y robo, las penas consideradas eran benignas, algunos especialistas criticaron esta característica, pedían que sean más draconianas para que las autoridades judiciales tengan una herramienta efectiva para sancionarlos; al parecer el tiempo le dio la razón, inicialmente se aumentaron levemente las penas e incorporaron circunstancias agravantes, lo cual no fue la solución, viéndose los legisladores a hacer la norma más severa, teniendo en cuenta la aparición de una delincuencia más violenta y organizada, aunado a esto la corrupción generalizada; se aumentaron las penas hasta la cadena perpetua, se pretendió con ello disuadir a los delincuentes; pero los resultados no fueron satisfactorios y la delincuencia siguió creciendo.
Se hizo un análisis de la parte teórica, la parte legislativa y los acuerdos en que el Perú se comprometió en realizar acciones efectivas para combatir estos delitos; asumiendo que las estrategias utilizadas fracasaron, se necesitaba la aplicación de otras que sean adecuadas a la realidad.
Se llegaron a las conclusiones que el robo y el hurto son delitos de alto índice estadístico, las causas que los originan son sociales, económicos y culturales, siguen en aumento por la aplicación de tácticas y estrategias ineficaces, se recomiendan realizar acciones multisectoriales y lo establecido en el Plan Nacional de Seguridad Ciudadana.

An analysis was made of the theoretical part, the legislative part and the agreements in which Peru undertook to carry out effective actions to combat these crimes; Assuming that the strategies used failed, the application of others that are adequate to reality was needed.
