The main objective of this thesis seeks to determine the influence on the effectiveness in civil processes and oral litigation with electronic judicial file in the district of Santa Anita 2020, identifying the elements of efficiency in civil processes combining the theoretical-doctrinal analysis of the orality and information technologies for the benefit of the defendants. Along the same lines, it is analyzed how the current processes impose enormous burdens on the Peruvian judicial system that requires a greater amount of judicial resources, contravening the just nature of this power of the State. This research uses a basic research approach, which throughout the results obtained presents a correlational descriptive level, with a non-experimental design, presenting the survey to a population of 20 people (among Lawyers, Prosecutors and Judges) that allowed to determine the conclusions to the problem raised. The challenges of conciliating justice efficiently in our slow civil process were clearly and concisely evidenced, allowing us to search for new (innovative) ways to improve it with information technology tools that have a massive and citizen outreach in favor of the defendant, ensuring a focus of the defendant’s real issues in conflict.
