Análisis del derecho comparado sobre la protección a la familia frente al concubinato y al matrimonio

Abstract

La presente investigación es de estudio descriptivo de método cualitativo, enmarca una investigación documental teórico bibliográfico que, tuvo como objetivo analizar y comparar las diferentes legislaciones de los diversos países con respecto a las instituciones jurídicas como es el matrimonio y a la familia frente al concubinato. Por ello fue importante definir el matrimonio, la familia y el concubinato, sobre las bases del reporte actual estadístico publicados en el Perú publicado por las entidades oficiales, y así poder ver una realidad de un aumento de concubinato a nivel nacional e internaciones , donde el problema radica puesto que si bien es cierto están protegidas por las diversas constituciones, no se le protege ni se le promueve de la forma más apropiada, existiendo así diferentes falencias y trayendo consecuencias considerables en algunos países, donde se desnaturaliza las presentes instituciones jurídicas , incrementando de manera excesiva los concubinatos o uniones de hecho , dejando de lado el matrimonio y a la familia, no cumpliendo con los fines que establecen las diferentes regulaciones en sus actuales constituciones de los diferentes estados para dichas instituciones jurídicas.

The objective of this research was to analyze and compare the different legislations of the various countries with respect to legal institutions such as marriage and the family versus the common-law partner. For this reason, it was important to define marriage, family and common law, on the basis of the current statistical report published in Peru published by official entities, and thus be able to see a reality of an increase in common law at the national and international level, where the problem lies in the fact that although it is true that they are protected by the various constitutions, they are not protected or promoted in the most appropriate way, thus existing different shortcomings and bringing considerable consequences in some countries, where the present legal institutions are denatured, increasing concubinage or de facto unions excessively, leaving aside marriage and the family, not complying with the purposes established by the different regulations in their current constitutions of the different states for said legal institutions.
