The study entitled “Compensation to the legal father for the moral damage caused by the attribution of biological paternity“ focuses on determining the objective criteria that judges must consider when compensating the moral damage suffered by the false legal father due to an attribution of biological paternity. false Although non-pecuniary damage is not economic in nature, the judge must analyze each case to establish whether there is non-pecuniary damage and determine proportional compensation. The main objective of the research is to contribute to the defense of fundamental rights, such as dignity, biological truth and the right to identity of both the minor and the legal father. After a detailed study, it is concluded that the legal father should be compensated for non-material damage in cases of false attribution of biological paternity, as long as certain assumptions are guaranteed, such as willful or culpable action on the part of the mother when imputing the paternity, the separation of the spouses since the fact was known and the care of the minor in the custody of the legal father.
