The study aims to demonstrate that the Principe of Oportunity, is the resignation of the State to exercise its duty to prosecute perpetrators and partakers of the facts wich are of the characteristics of criminal offense, pursuant to a criminal policy, wich involves, first cancellation of interruption of criminal action by the Prosecutor and later his final year waiver. As a summary, we can say that when a provincial prison to take cognizance oh the existence of a crime prosecution, either by itself or on a complaint or police document, consider that 1) The fact satisfies the conditions laid down in the cases envisaged by Article 2° oh the Penal Code, 2) The course concerned is required by law, 3) There is suppotying documentation sufficient and 4) There is probable cause for criminal charges, it shall summon the defendant and agarviado in orden to try to those arriving at an agreement on the amount and payment of civil damages. In such a measure, counting with the consent of the parties, reached a settlement agreement and fulfilled it, we will proceed to the definitive archive of actuated; Otherwsive, no solution to any agreement, the prosecutor will proceed according to law. Act similarly in cases uncertainty as to the accused home.
