Abstract: El presente trabajo de investigación tiene como objetivo analizar la problemática actual del Desalojo por Ocupación Precaria durante el estado de emergencia COVID -19 en el Perú y determinar que durante la Pandemia se realizaron casos de desalojos ilegítimos.
Para el desarrollo trataremos conceptos teóricos sobre la ocupación Precaria y mecanismos de protección.
De igual modo dilucidar como esta situación facilitó la posibilidad de interponer la demanda de Desalojo por incumplimiento del pago de la renta y convertir a un inquilino en Precario, tomando en cuenta el Art. 7, Inc. 7.1 del D. S. N° 044-2020-PCM que dispuso el aislamiento social obligatorio, suspendiendo cualquier actividad que suponga riesgo de contagio.
Asimismo, se comparará las medidas adoptadas en nuestro país con las medidas internacionales.
The objective of this research work is to analyze the current problem of Eviction due to Precarious Occupation during the COVID -19 state of emergency in Perú and to determine that during the Pandemic cases of illegitimate evictions were carried out. For the development we will deal with theoretical concepts about Precarious occupation and protection mechanisms. Similarly, elucidate how this situation facilitated the possibility of filing an eviction lawsuit for non-payment of rent and converting a tenant into Precarious, taking into account Art. 7, Inc. 7.1 of Supreme Decree No. 044-2020- PCM that ordered mandatory social isolation, suspending any activity that poses a risk of contagion. Likewise, the measures adopted in our country will be compared with international measures.
