In recent years, the relationship of companies with society has changed, regarding Corporate Social Responsibility, since the 21st century, companies are having more relevance. Thus, Social Responsibility is present in all types of companies, private or state, what varies in each country is the degree of involvement. In our country, we are still starting to create business awareness, so there is no regulatory framework that responds to the exact, relevant and empowering Corporate Social Responsibility; otherwise, we can see it in other countries; such is the case that in some Latin American countries, such as Argentina, Colombia, Costa Rica and Chile, bills they have presented to make CSR mandatory. In the following investigation, it is intended to delimit the effect of the compulsory nature of CSR, referring to the protection of the right to Freedom of Enterprise in Peru; since it could be considered, as guidelines for each company in order to become aware and contribute to society, the environment our future generations. A fact that is of the utmost urgency in our country and that in the future it is due to business awareness and social commitment and not due to coercion, enforceability of the laws.
