The ongoing investigation, under the title “Effectiveness of the Application of the Opportunity Principle for Driving While Drunk, in the District of Santa Ana, Year 2022”, delves into the criteria of Article 2 of the Criminal Procedure Code, the which support the application of the Opportunity Principle. In this context, the Public Ministry faces the duality of exercising criminal action or renouncing prosecution, opting for the implementation of the Principle of Opportunity. This scenario opens the door to a conciliation process, in which both the accused and the injured party can agree to pay civil compensation as a solution to the conflict, thus avoiding a criminal process that could be detrimental to both parties. “ The main objective of the investigation is to evaluate the effectiveness of the application of the principle of opportunity, analyzing the prosecutor's decisions in relation to what is established in Article 2 of the CPP” . It is important to note that this method of conflict resolution is only applicable as long as it does not alter what is typified in Literal a) of Article 2 of the CPP. The approach is Qualitative of a basic type, the Scenario is the Prosecutor's Office of the District of Santa Ana, year 2022, documentary analysis and interviews were used to collect data.
