The present research work analyzes the influence of the child's best interest in the custody of the minor in divorce cases in the city of Lima, during the year 2022. Currently, divorce cases have increased exponentially, parents’ divorce or separate for different reasons, and the actions of this fall on the children. These consequences do not allow the minor to obtain a comprehensive development in some cases. Ideally, in families, children should develop with both parents and exercise parental authority together. It is becoming more and more common for parents to choose to live separately and this affects the minor in different ways, but directly to the family as such, which also means that one of the parents must obtain parental authority and custody of the child. In this case, the judge will evaluate against facts and suggestions to choose between the parents who have greater psychological maturity and can provide greater emotional stability to the minor, the other parent will also have obligations of the right to food and visits, as they agree. If it is the case that a parent cannot guarantee the care of the minor, either because they do not have the time, emotional or psychological stability, to ensure the well-being of the minor. The judge may change parental authority and grant it to the other parent or, if necessary, to a relative of the minor, to guarantee their well-being. In this way, the principle of the best interests of the child prevails, ensuring their mental and physical development for the future. The possession of the minor can change, in the face of exposed situations, from one parent to another or relative, looking for the most prolific person, guaranteeing the universal principle that is to ensure the rights of the minor.
