Incidencia del delito de violencia familiar en el distrito judicial de Lima Sur-2021

Abstract

La violencia en las familias y en las parejas ha resultado ser lo más común en este tiempo y mucho más a raíz del Covid-19, en el que, el confinamiento ha resultado ser un gran problema que está relacionado con la violencia familiar, siendo una realidad preocupante y alarmante el incremento de maltratos contra niños, niñas, adolescentes y especialmente contra la Mujer. Asimismo, es uno de los temas más polémicos en la actualidad. En el distrito Judicial de Lima Sur se puede evidenciar que el delito de violencia familiar está dejando evidencia a otra realidad, el problema a través del tiempo se ha ido incrementando notablemente, más aún como hemos señalado dentro de las circunstancias del estado de emergencia sanitario; revisaremos la legislación sobre la materia para determinar si los preceptos normativos son suficientes para acabar con la ola de. la violencia familiar o se necesita otro tipo de mecanismos o sanciones para erradicar el maltrato que se da dentro del núcleo familiar sobre todo a las personas más vulnerables como son los niños y las mujeres, además se debe considerar que muchos de los casos de violencia familiar no son denunciados ni puestos en conocimiento de las autoridades administrativas ni policiales, lo que hace más difícil aún cualquier intervención de parte del Estado para poder erradicar la violencia familiar; es importante señalar que en el presente trabajo se realizó un evaluación doctrinaria y dogmática sobre el componente del delito de violencia familiar ; llegando a analizar cada uno de los efectos que producen estos maltratos y el porqué el ensañamiento que en su mayoría son sus parejas o exparejas.
