Análisis de la función notarial en el reconocimiento de la capacidad jurídica en las personas con discapacidad, Comas 2022

Abstract

El objeto de la presente investigación fue analizar de qué manera la función notarial afecta en el reconocimiento de la capacidad jurídica en las personas con discapacidad, debido a la limitación jurídica y social que viven este grupo de población ante esta autoridad, a pesar de la normativa vigente. A fin de responder el objetivo de estudio, se optó por una investigación bajo el enfoque cualitativo de tipo básico, conteniendo un nivel descriptivo con diseño fenomenológico y hermenéutico. Donde la muestra se constituyó por 06 abogados expertos con amplia experiencia en la materia. La técnica aplicada fue la guía de entrevista donde se planteó 09 preguntas directamente relacionadas con los objetivos. En base a la investigación realizada y resultados obtenidos de abogados expertos, se concluyó que el reconocimiento de la capacidad jurídica en las personas con discapacidad se ve afectada en el ámbito de la función notarial, dado que dado que jurídicamente limitan a realizar trámites notariales y socialmente no brindan accesibilidad a sus instalaciones y servicios notariales.

The purpose of this research was to analyze how the notary function affects the recognition of legal capacity in persons with disabilities, due to the legal and social limitation that this population group experiences before this authority, despite the current regulations. In order to respond to the objective of the study, a basic qualitative research approach was chosen, containing a descriptive level with a phenomenological and hermeneutic design. The sample consisted of 8 expert lawyers with extensive experience in notarial matters. The technique applied was the interview guide where 9 questions were posed directly related to the objectives. Based on the research conducted and results obtained from expert lawyers, it was concluded that the recognition of legal capacity in people with disabilities is affected in the field of the notarial function, given that legally they are limited to perform notarial procedures and socially they do not provide accessibility to their facilities and notarial services.
