Implicancias del enfoque responsivo en las labores de fiscalización minero-ambiental del OEFA

Abstract

El presente trabajo académico abarca el análisis jurídico comparado del enfoque responsivo en las labores de fiscalización del sector minero-ambiental en el OEFA. El análisis se centra desde una perspectiva histórica cuáles han sido los alcances de la potestad fiscalizadora o inspectora en el sector minero-ambiental. Luego, se analiza el enfoque punitivo y orientativo; a fin de verificar cuál es el criterio que debe trazarse en aras de la protección del medio ambiente. Por lo anterior, la fiscalización contaría con los enfoques preventivo, gestión del riesgo, orientativo y procura de enforcement normativo. Además, con el panorama de la fiscalización, se analiza las actuales herramientas regulatorias utilizadas por OEFA. Sobre ello, surge la pregunta ¿las herramientas regulatorias cumplen con las metas?; a pesar de las estadísticas, se considera que las muestras arrojan resultados poco prometedores; por lo que, se proponen nuevos enfoques y herramientas para la protección del medio ambiente. En ese orden de ideas, la investigación se fundamenta en cómo se pueden proteger los derechos fundamentales coligados al medio ambiente y qué técnicas regulatorias se pueden implementar a través de la potestad fiscalizadora del OEFA, la cual durante estos últimos años tiene un enfoque de gestión de riesgos y resultados. Por consiguiente, al finalizar el desarrollo del presente trabajo, se podrá concluir cuáles han sido los resultados del uso de dichas herramientas regulatorias y oportunidades de mejora.

The present academic work covers the comparative legal analysis of the responsive approach in the inspection work of the mining-environmental sector in OEFA. The analysis focuses from a historical perspective on the scope of the supervisory or inspection power in the mining-environmental sector. Then, the punitive and indicative approach is analyzed; in order to verify what is the judgment that must be drawn for the sake of environmental protection. Due to the foregoing, the control would have the preventive, risk management, guidance and regulatory enforcement approaches. In addition, with the inspection panorama, the current regulatory tools used by OEFA are analyzed. On this, the question arises: do the regulatory tools meet the goals?; despite the statistics, the samples are considered to give unpromising results; Therefore, new approaches and tools for environmental protection are proposed. In this order of ideas, the investigation is based on how fundamental rights related to the environment can be protected and what regulatory techniques can be implemented through the supervisory authority of the OEFA, which in recent years has had a risk management approach. risks and results. Therefore, at the end of the development of this work, it will be possible to conclude what have been the results of the use of said regulatory tools and opportunities for improvement.
