The crime of incompatible negotiation is typified in article 399 of the Peruvian Penal Code. However, its typification has brought many problems regarding its application. In this sense, we consider that the classification of the crime of incompatible negotiation as preparatory acts of the crime of collusion is a viable alternative, to solve some of these problematic aspects of this crime. Regarding its classification as a punishable preparatory act, this crime meets the criteria of classification that falls on the legal right and its dangerousness. Likewise, this crime and that of collusion have different objective elements in common and since it is a crime of punishable preparation, its guiding verb “to be interested“ is read as an act prior to the agreement between the official and interested third party, with which it gives this crime a higher priority to identify the third party who actively participates in the execution of the crime. Finally, we maintain that it is possible to decriminalize the crime of incompatible negotiation as an autonomous crime and, on the contrary, it is a good option for it to function as a punishable preparatory act for the crime of collusion. With this premise, we would be facing a conduct that continues to be illegal, but with a reduced penalty.
