The research work presented below is the result of an investigation into integral mining formalization and the associated multidimensional impacts, where a particular case was analyzed, such as the breakage of the waste disposal facilities and contingency pond in the María mining concession. The general objective is to analyze the regulation of mining waste management within the framework of the integral mining formalization process, in light of the case of waste dump breakage in the María mining concession. The specific objectives are to identify the environmental damage caused by the waste dump breakage, examine the Peruvian environmental protection policy in mining waste management, determine whether mining waste management within the framework of the integral mining formalization process requires the approval of a law, and understand the population's perception of waste dump breakage. The methodology used for data collection and analysis is developed in various dimensions: a regulatory impact analysis approach, a case analysis approach, and a comparative approach. The results and main conclusions show the need to implement environmental protection measures in special regulations, which consider aspects of design, construction, operation, and monitoring in line with international trends and that standardize environmental protection measures in order to prevent environmental damage that over time can represent a real danger to the health of the population, facilities, and the environment.
