Abstract: El presente artículo busca sugerir determinadas líneas de acción que el Estado peruano
debería tomar para brindar una eficaz protección a las personas apatridas en nuestro
país ante la evidente laguna normativa que existe en la materia en nuestro país. Para
ello, en principio, se ha desarrollado una explicación terminológica alrededor de lo qué
implica ser una persona apátrida, con el fin de demostrar la vulnerabilidad que afrontan
tales personas y cómo se ve afectado e ejercicio de sus derechos humanos. Asimismo,
se ha analizado la regulación actual en el Perú alrededor de la materia, a partir de la
cual se busca reflejar los obstáculos y deficiencias que presenta cuando de apatridia y
reconocimiento de nacionalidad se trata. Para finalmente, proponer medidas de
prevención y erradicación que sean aplicables como solución ante este problema,
incluso con ayuda de las nuevas tecnologías. Todo ello, en el marco de los diversos
tratados internacionales en la materia, la jurisprudencia e incluso el desarrollo normativo
constitucional de nuestro país. Pues, en conclusión, aún existen muchas circunstancias
por cubrir por la normativa estatal en materia de apatridia. Mucho más, considerando
que nuestro país es uno de los países con más alto recibimiento de personas migrantes
en la región y el mundo.
This article seeks to suggest certain lines of action that the Peruvian State should take to provide effective protection to stateless persons in our country in view of the obvious regulatory gap that exists in this area in our country. To this end, first of all, we have developed a terminological explanation of what it means to be a stateless person, in order to demonstrate the vulnerability faced by such persons and how the exercise of their human rights is affected. Likewise, the current regulation in Peru on the matter has been analyzed, from which we seek to reflect the obstacles and deficiencies it presents when it comes to statelessness and recognition of nationality. Finally, to propose measures of prevention and eradication that are applicable as a solution to this problem, even with the help of new technologies. All this, within the framework of the various international treaties on the subject, the jurisprudence and even the constitutional normative development of our country. In conclusion, there are still many circumstances to be covered by state regulations on statelessness. Much more, considering that our country is one of the countries with the highest number of migrants in the region and the world.
