The Peruvian state acknowledges the seriousness and the problematic nature of human trafficking. The supreme and ultimate goal of the State is the defense of the human person and their dignity. However, in Appeal of Nullity No. 2349-2014, the Supreme Court of Justice of the Republic decides, contradictorily to the accepted evidence, to acquit the accused person. It is important to note that Appeal of Nullity No. 2349-2014 concerns the recruitment, transportation, retention, and subsequent labor exploitation carried out by Mrs. Elsa Cjuno Huillca against the minor identified by initials D.R.Q.R. from January 2, 2008, to January 27, 2008. This was done with the purpose of the minor working as a companion in her own bar. This situation leads to questioning whether the decision of the supreme judges aligns with the legal framework established by the Peruvian state in combating human trafficking. Furthermore, in accordance with the principle of “good governance,“ understood as the appropriate and responsible exercise of power and the fulfillment of state function, ensuring the realization of human rights and the protection of the public interest, it is appropriate to question the judicial actions.
