Abstract: El presente Informe Jurídico versa sobre el análisis de la Resolución 1934-
2009/SC2-INDECOPI, respecto al deber de idoneidad brindado en los servicios
médicos y la infracción al artículo 8 del Decreto Legislativo N°716. En relación
con lo expuesto las finalidades del presente Informe es de analizar i) que es un
servicio médico idóneo, ii) el alcance que tiene el concepto paciente dentro de
la relación de consumo y iii) si la medida correctiva protege el derecho a la
Reparación por daños y perjuicios.
Conforme a ello, en primer lugar, se expondrá brevemente los hechos del caso
que conllevaron a la infracción del artículo 8 del Decreto Legislativo N°716
respecto a la falta de diligencia de los profesionales de la salud e idoneidad en
el servicio médico. Se hará el desarrollo de los aspectos que requiere todo
servicio médico idóneo: i) historia clínica, ii) consentimiento informado, iii)
receta, iv) diagnóstico y protocolo médico y v) proceso individual de atención.
En segundo lugar, se expondrá la relación de consumo que tiene todo servicio
que se ofrece, pero en el caso en concreto será analizado desde el punto de
vista del paciente; concluyendo en un tercer punto con el análisis de verificar si
la medida correctiva impuesta a la Clínica ha sido la más adecuada.
El presente Informe Jurídico ha sido desarrollado en base a las normas de
alcance de Protección al Consumidor como el Código de Protección al
Consumidor, el Decreto Legislativo N°716 y Resoluciones emitidas por Indecopi
que versan respecto al caso.
This Legal Report deals with the analysis of Resolution 1934-2009/SC2- INDECOPI, regarding the duty of suitability provided in medical services and the infringement of Article 8 of Legislative Decree No. 716. In relation to the above, the purpose of this Report is to analyze i) what is a suitable medical service, ii) the scope of the concept of patient within the consumer relationship and iii) whether the corrective measure protects the right to compensation for damages. Accordingly, in the first place, the facts of the case that led to the infringement of Article 8 of Legislative Decree No. 716 regarding the lack of diligence of the health professionals and the lack of suitability of the medical service will be briefly explained. The following aspects will be developed: i) medical history, ii) informed consent, iii) prescription, iv) diagnosis and medical protocol and v) individual care process. Secondly, the consumer relationship of any service offered will be explained, but in the specific case it will be analyzed from the patient's point of view; concluding in a third point with the analysis of whether the corrective measure imposed to the Clinic has been the most appropriate. This Legal Report has been developed based on the rules of scope of Consumer Protection such as the Consumer Protection Code, Legislative Decree No. 716 and Resolutions issued by INDECOPI that deal with the case.
