Public Procurement is one of the activities of the State with the highest risk of corruption and bad use of public funds; precisely due to the large amount of money that is allocated annually for this purpose. Taking into consideration this scenario and above all with the purpose of protecting public funds whose purpose must be, exclusively, the satisfaction of the public interest that our current legislation on contracting with the State has regulated over the years certain impediments to contracting with public entities aimed at senior public officials and their spouses, partners and closest relatives; this in order to avoid any type of risk of corruption or favoritism whose sole purpose is the satisfaction of a particular interest. It is in light of these facts, then, that in this Legal Report the analysis carried out by the Constitutional Court in one of its judgments is questioned where it declares that said impediments referred to the closest relatives of the Congressmen of the Republic violate constitutional rights ; without taking into account the purpose of these restrictions or the high risk of corruption and favoritism that would exist if they were not available.
