Abstract: La presente investigación tiene como objetivo identificar las vulneraciones a los
derechos fundamentales de la Comunidad Nativa Tres Islas a través de los actos
administrativos que fueron expedidos por el Gobierno Regional de Madre de Dios y a
Autoridad Nacional del Agua, afectando el territorio, dañando la autonomía comunal,
medio ambiente sano de sus integrantes, entre otros.
Se enunciará cuáles fueron los fundamentos de la primera y segunda instancia de la
Corte Superior de Justicia de Madre de Dios para resolver la demanda de amparo
interpuesta, en virtud de la interpretación de unidad de la Constitución y el principio in
dubio pro homine.
Del mismo modo, se buscará comprobar la viabilidad de un proceso de amparo como la
vía pertinente constitucional interpuesta para la protección de los derechos debido a un
latente peligro de irreparabilidad. Ello, ante un análisis dificultoso debido a la omisión
normativa del derecho a la consulta previa existente por responsabilidad estatal
excluyente, al no elaborar una regulación interna oportuna para la implementación de
procedimientos adecuados, viéndose perjudicados, a su vez, los derechos de los
miembros de esta.
Finalmente, como conclusión principal obtenida se visualiza las consecuencias de las
competencias conferidas en materia de minería al Gobierno Regional de Madre de Dios
al no haber sido adecuados, así como se identifica y sostiene la preponderancia del
autogobierno comunal frente a los derechos de los mineros en virtud de la libertad de
empresa del caso en concreto.
The objective of this research is to identify the violations of the fundamental rights of the Comunidad Nativa Tres Islas through the administrative acts that were issued by the Gobierno Regional de Madre de Dios and the Autoridad Nacional del Agua affecting its territory, damaging its community autonomy, healthy environment of its members, among others. It will state what were the grounds of the first and second instance of the Corte Superior de Justicia de Madre de Dios to resolve the petition for amparo filed, by virtue of the interpretation of the unity of the Constitution and the principle in dubio pro homine. Likewise, it will seek to verify the viability of an amparo process as the ideal constitutional path interposed for the protection of rights due to the danger of irreparability. This ocurred, facing a difficult analysis due to the existing normative omission of the right of prior consultation due to an exclusive responsibility of the State, by failing to draw up a timely internal regulation for the implementation of adequate procedures, which led to harm the rights of the native community members. Finally, as the main conclusion obtained, the consequences of the competences conferred on mining matters to the Gobierno Regional de Madre de Dios are visualized as they were not adequate, as well as the preponderance of communal self-government over the rights of miners in virtue of the freedom of enterprise of the specific case.
