Abstract: El caso por el cual Aurelio Pastor Valdivieso, reconocido político peruano, fue
sentenciado en primera y segunda instancia por la comisión del delito de tráfico de
influencias y absuelto por la Casación 374-2015 Lima es un antecedente muy importante
para comprender cómo en nuestro país se ha venido entendiendo la naturaleza de este
delito, en especial, la modalidad de “influencias simuladas”. Es así como buscaremos, en
primer lugar, identificar el bien jurídico tutelado por el tipo penal “tráfico de influencias”
mediante el análisis de las distintas posturas al respecto, así como presentar los elementos
necesarios para su configuración. En segundo lugar, evaluaremos si el ejercicio legítimo
de la profesión de abogado podría ser tomado como una causa justificante para el delito
de tráfico de influencias simuladas, conforme a lo señalado por la Corte Suprema,
amparándose en que los actos por los que Aurelio Pastor fue sentenciado corresponderían
a gestiones de intereses que los abogados estarían autorizados a hacer en búsqueda de
cumplir con el derecho a la defensa de sus patrocinados. Por último, el presente informe
jurídico buscará identificar si en el caso específico existió una incitación por parte del
tercero interesado en la ejecución de las influencias invocadas configurando un delito
provocado.
The case for which Aurelio Pastor Valdivieso, renowned Peruvian politician was sentenced in first and second instance for the commission of the crime of influence peddling and acquitted by the Cassation 374-2015 Lima is a very important precedent to comprehend how the nature of this crime has been understood in our country, especially in the “simulated influences” modality. In this way we pretend to, in first place, identify the protected juridical good by the crime of influence peddling by analyzing the different positions in this regard, as well as presenting the necessary elements for its configuration. In second place, we will evaluate whether the legitimate exercise of the legal profession could be taken as a justifying cause for the crime of simulated influence peddling, in accordance with the Supreme Court, based on the fact that the acts for which Aurelio Pastor was sentenced would correspond to interest management that lawyers would be authorized to do in order to comply with the right to defense of their clients. Finally, this legal report will seek to identify whether in the specific case there was an incitement by the third party interested in the execution of the pleaded influences, configuring a provoked crime.
