Abstract: En el presente informe jurídico se busca dilucidar si existió o no un caso de competencia
desleal, por infracción a la cláusula general, a la luz de lo estipulado en la Ley de Represión de
Competencia Desleal – Decreto Legislativo Nº 1044 (LRCD). Lo anterior a partir de uno de
los casos más controversiales, recaído en la Resolución 0086-2019/SDC-INDECOPI, sobre el
álbum de figuritas “3 reyes” de titularidad de Capri Internacional S.A., en comparación con el
de Panini, con temática del Mundial FIFA Rusia 2018. Asimismo, se analizará si la Comisión
de Fiscalización de la Competencia Desleal (CCD) debió dictar de oficio una medida cautelar,
con la finalidad de salvaguardar el orden del mercado. En ese sentido, se concluye que sí hubo
una infracción a la cláusula general de la LRCD, en tanto se quebrantó la buena fe empresarial
que es la base de una leal competencia en el mercado, al no contar con las autorizaciones
correspondientes para el uso de imagen de los futbolistas del mencionado certamen. Por otro
lado, se analiza y desarrolla que la CCD sí debió dictar una medida cautelar ya que se cumple
con cada uno de los requisitos necesarios para otorgarlo, así como por la reiterancia de este tipo
de casos a lo largo de los años.
In this legal report we attempt to clarify whether or not there was a case of unfair competition, for violating the general clause, in accordance with the stipulations of the Law on Suppression of Unfair Competition - Legislative Decree No. 1044 (LRCD). All based on one of the most controversial cases, which is the result of Resolution 0086-2019/SDC-INDECOPI, regarding the album of figures “3 kings“ owned by Capri Internacional S.A., compared to the Panini album of the FIFA World Cup Russia 2018. Furthermore, it will be analyzed whether the Commission for the Control of Unfair Competition (CCD) should have dictated a precautionary measure on its own initiative, with the purpose of protecting the order of the market. In that sense, the conclusion is that there was an violation of the general clause of the LRCD, since there was a infringement of good business faith, which is the basis of fair competition in the market, by not having the necessary authorizations for the use of the soccer players' image in the above mentioned championship. On the other hand, it is analyzed and explained that the CCD should have dictated a precautionary measure since it fulfills each one of the necessary requirements to grant it, as well as due to the recurrence of this type of cases throughout the years.
