This research article develops the immovable historical heritage from its constitutional delimitation to its development in the special legal and regulatory norms; as well as its important relevance starting from the set of movable and immovable assets that make up the cultural heritage of the Nation. These goods can be denominated of private or public domain, being important their classification in order to notice their different responsibilities and/or burdens established within the regulatory framework in which the actions or omissions are described in order to comply with the public purpose of conservation and preservation of the cultural heritage of the Nation. The description of this typology of ownership will provide us with doctrinal and legal tools in order to present the assumption that is the subject of our work, which refers to the special scope of powers attributed to the Ministry of Culture with respect to the Historic Heritage, the main administrative authority with which the owners will maintain a legal relationship, through which one of the parties is subject to a procedure in which it will have to submit the corresponding documents in order to obtain some possibility of action with respect to its property.
