Abstract: El presente informe jurídico analiza la Resolución N° 001882-2021-SERVIR/TSC-
Primera Sala, emitida por el Tribunal del Servicio Civil - SERVIR, la cual resuelve el
recurso de apelación interpuesto por la servidora Liliana Margot Chanamé Castillo,
Directora General de la Oficina General de Recursos Humanos del Ministerio de Cultura,
contra la Resolución N° 000135-2021-SG/MC emitida por la Secretaría General de la
entidad.
Los hechos versan principalmente en si la servidora habría -presuntamente- elaborado los
Términos de Referencia de las órdenes de servicio N° 2172-2019, N° 3704-2019, N°
4236-2019 y N° 673-2020 y, posteriormente, habría otorgado la conformidad de las
mismas, a fin de beneficiar indebidamente a Richard Cisneros Carballido, quien, como
proveedor del servicio contratado, no habría cumplido a cabalidad con sus obligaciones
contractuales.
En consecuencia, el 5 de octubre del 2020, a través de la Resolución Directoral N°
000221-2020-OGRH/MC, la Dirección General de la Oficina General de Recursos
Humanos del Ministerio de Cultura inició el procedimiento administrativo disciplinario
en contra de la citada servidora, el mismo que concluyó con la imposición de la máxima
sanción, destitución del cargo de Directora General de la Oficina General de Recursos
Humanos.
En ese sentido, en el presente informe se analizarán los principales problemas jurídicos
identificados en la Resolución N° 001882-2021-SERVIR/TSC-Primera Sala, bajo el
análisis de la normativa interna del Ministerio de Cultura, legislación pertinente, doctrina
y jurisprudencia, respecto al procedimiento administrativo disciplinario, las obligaciones
contractuales y los presuntos actos de corrupción en los que estaría involucrada la
servidora. Luego, se compartirá la posición personal sobre los temas discutidos.
Finalmente, se expondrán las conclusiones y recomendaciones, a fin de dilucidar una
correcta interpretación de nuestras normas aplicables al procedimiento administrativo
disciplinario.
This legal report analyzes Resolution No. 001882-2021-SERVIR/TSC-First Chamber, issued by the Civil Service Tribunal - SERVIR, which resolves the appeal filed by Liliana Margot Chanamé Castillo, Director General of the General Office of Human Resources of the Ministry of Culture, against Resolution No. 000135-2021-SG/MC issued by the General Secretariat of the entity. The facts mainly deal with whether the servant would have -allegedly- prepared the terms of reference of service orders N° 2172-2019, N° 3704-2019, N° 4236-2019 and N° 673- 2020 and, subsequently, would have granted the conformity thereof, in order to unduly benefit Richard Cisneros Carballido, who, as provider of the contracted service, would not have fully complied with his contractual obligations. Consequently, on October 5, 2020, through Directorial Resolution No. 000221-2020- OGRH/MC, the General Directorate of the General Office of Human Resources of the Ministry of Culture initiated the disciplinary administrative procedure against the aforementioned servant, which concluded with the imposition of the maximum sanction, dismissal from the position of General Director of the General Office of Human Resources. In this regard, this report will analyze the main legal problems identified in Resolution No. 001882-2021-SERVIR/TSC-First Chamber, under the analysis of the internal regulations of the Ministry of Culture, relevant legislation, doctrine and jurisprudence, regarding the administrative disciplinary procedure, the contractual obligations and the alleged acts of corruption in which the civil servant was involved. Then, the personal position on the issues discussed will be shared. Finally, conclusions and recommendations will be presented, in order to elucidate a correct interpretation of our rules applicable to the administrative disciplinary procedure.
