This study analyzes the importance of prior consultation in infrastructure projects that affect indigenous peoples in Peru, focusing on the case of the 220 KV Moyobamba-Iquitos Transmission Line and Associated Substations project. The relevance of this research lies in its complexity and the impact on the collective rights of indigenous peoples, as well as the need to balance economic development with the protection of these rights. My objectives are to examine whether the right to prior consultation has been respected, identify the main legal issues that arise in this context, and propose recommendations to improve the application of this right in future projects. I aim to achieve a deeper understanding of how prior consultation can be an effective tool for the participation of indigenous peoples in decision-making, ensuring that their rights are adequately considered and protected, especially in the case of electrical infrastructure projects. The main conclusion is that prior consultation should be conducted before the implementation of any project that could affect the rights of indigenous communities, respecting the normative hierarchy and principles of legality to ensure the protection of their rights at all times. It is also urged that the State provide indigenous peoples with the necessary protection to safeguard their territories.
